Data Processing Addendums

Dear Business Partner:

ConstructConnect has decided to broadly adopt certain best practices required by the California Consumer Privacy Act (CCPA). One of these best practices is to offer relevant Data Processing Addendums to Business Partner service contracts. This practice is intended to specifically identify, confirm and accept each party’s respective obligations relating to the sharing of Personal Information for commercial purposes.

Please choose the most relevant of the following options and complete and sign electronically the document linked to that option:

You are a subscriber to one of ConstructConnect’s general contractor bid management solutions (ConstructConnect Bid Management, iSqFt Bid Management or SmartBid) or a license holder of one of our takeoff application brands (ConstructConnect, On Center, PlanSwift or QuoteSoft) for the commercial purpose of sending project-specific invitations-to-bid to third parties.

In this business relationship, you are the Data Controller and ConstructConnect is a Data Processor that receives and processes Personal Information shared by you.

You are a subscriber to one of ConstructConnect’s trade contractor or BPM platforms (ConstructConnect, iSqFt, CDC, CMD, Insight, or BidClerk) for the commercial purpose of reviewing and bidding on projects.

For the Personal Information that you provide to ConstructConnect, you are the Data Controller and ConstructConnect is a Data Processor.

For the Personal Information that ConstructConnect provides to you, ConstructConnect is the Data Controller and you are a Third Party.

You are a vendor who either uses or has access to ConstructConnect Personal Information exclusively to provide services to ConstructConnect and you may only retain, use, or disclose information in order to perform a service provided in a contract.

In this business relationship, ConstructConnect is considered the Data Controller. You are a Data Processor.

“Personal Information” means, broadly, information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a customer, user, design professional or employee of ConstructConnect. In addition to name, address, and other directly identifying information, Personal Information may also include, without limitation: IP address and online activities; geolocation; and personal preferences, characteristics, and behavior.

“Business Partner” means vendors, general contractors, trade contractors, building product manufacturers (BPM), and other sources of project material.

“Data Controller” means an entity that collects or directs the collection of information and determines the purposes and means of the processing of Personal Information.

“Data Controller” relates to the term “Business” under CCPA.

“Data Processor” means an entity that processes information on behalf of a business and to which the business discloses Personal Information for a business purpose pursuant to a written contract. A Data Processor cannot retain, use, or disclose personal information for any purpose other than for the specific purpose of performing the services specified in the contract for the business. “Data Processor” relates to the term “Service Provider” under CCPA.

“Third Party” relates to the same term under CCPA, and generally means an entity that is neither a Data Controller nor Data Processor as it relates to privacy requirements.

Please complete the appropriate document that best applies to the nature of our business relationship and sign it electronically.
